What's Happening This November?
In November 2025, as part of the deal that ended the federal government shutdown, Congress passed and President Trump signed a government funding law (Public Law 119-37) that includes a provision—Section 781—redefining hemp at the federal level. Instead of the 2018 Farm Bill's delta-9-only standard, hemp will now be measured on a "total THC" basis (0.3% by dry weight, including THCA), and finished hemp products like beverages will be capped at 0.4 mg of total THC per container. The law also bars cannabinoids synthesized outside the plant, like delta-8 THC. Those changes are scheduled to take effect November 12, 2026. If that deadline passes without further action from Congress, it would affect the large majority of hemp beverages currently sold across the country.
It's important to know that nothing changes today. Hemp beverages like Louie Louie remain legal where permitted, and the industry continues working with lawmakers to advocate for a thoughtful regulatory framework rather than an outright ban.
That work is already underway: this summer, the White House asked Congress to either delay the November deadline or adopt a new regulatory framework, and Rep. Andy Barr (R-KY) has introduced a proposal—the Lawful Hemp Protection Act—that would regulate hemp beverages instead of banning them. Trade groups including the National Restaurant Association have also urged Congress to regulate, not ban, hemp THC drinks.
