In August 2026, the U.S. Senate voted to delay implementation of those federal hemp restrictions by approximately one month, moving the effective date from November 12 to December 11, 2026. The change is part of a federal funding measure that still requires final approval before becoming law.
In other words: the federal hemp-THC timeline has been pushed back, giving the industry and lawmakers more time to figure out what comes next.
But that federal change is separate from what's currently happening in Texas.
Are THC Drinks Legal in Texas?
Yes, certain hemp-derived Delta-9 THC drinks are currently legal in Texas.
Texas law allows consumable hemp products containing Delta-9 THC at a concentration of no more than 0.3% on a dry-weight basis, subject to Texas's other requirements for hemp products.
Texas has recently taken a different approach to other forms of THC.
Beginning July 31, 2026, Texas reinstated the state's scheduling of synthetic products such as Delta-8 and Delta-10, meaning products containing more than trace amounts of synthetic THC are no longer be treated the same way as compliant hemp products.
That's why it's important to pay attention to which type of THC is in a product rather than simply looking for the words "THC" or "hemp."
